Four persons have been charged and arraigned before the Ogudo Magistrate Court in Orumba North local government area of Anambra state for misdemeanor and spreading false information over the murder of late Mr Tochukwu Onyemelukwe.
The the case was filed by the Inspector General of Police who made the following charges;
“That you Joseph m, Godson Ofokansi, m, Martin Okeke m and Jacob Emmanuel m sometimes in the month of December 2021 at Enugu Nanka- in Orumba North LGA of Anambra state, within the jurisdiction of this Honorable Court did conspire among yourselves to commit a misdemeanor to wit giving false information to a public servant and you thereby committed an offence punishable under 496 (a) of the criminal code law cap 36 vol 11 Reversed laws of Anambra state of Nigeria, 1991 as amended “
“That you Joseph Omegha m, Godson Ofokansi m Martin Okeke m Jacob Enemuo m sometimes in the month of December 2021 at Enugwu Nanka- in Orumba North LGA of Anambra state, within the jurisdiction of this Honorable Court did with intention to mislead a public officer ,wrote a petition to the Assistant Inspector General of Police , FCID annex Enugu alleging that one Tochukwu Onyemelukwe in a broad day light, the fact you know to be false with the intention to cause the Assistance Inspector General of Police to use his lawful power to the prejudice of the said Emmanuel Ezeobi and others and you thereby committed an offence punishable under section 154 (1) (b) of the criminal code law cap 36 vol 11 Reversed laws of Anambra state of Nigeria 1991 as amended”
“That you Joseph Omegha m Godson Ofokansi m Martin Okeke m and Jacob Enemuo m sometimes in the month of December 2021at Enugwu Nanka-in Orumba North LGA of Anambra state within the jurisdiction of this Honorable Court did conduct yourselves in a manner likely to cause the breach of public peace when you without any concrete evidence and out of malice falsely accused one Emmanuel Ezeobi and others fir killing one Tochukwu Onyemelukwe in a broad day light and you thereby committed an offence punishable under section 247 (d) of the Criminal code law cap 36 vol 11 Reversed laws of Anambra state of Nigeria 1991 as amended”
In Her ruling the Chief Magistrate Chioma Ikejiofor adjourned the proceedings to September 29 2023 for plea and further motions why the defendants were ordered to pay the court the sum of N50,000.00 before the next adjourned date.
